Terms of service
These terms govern the use of TactiCourt (web and desktop app) between the provider, TactiCourt (tax ID (NIF/CIF) [TO COMPLETE: tax ID], [TO COMPLETE: address]), and you, the person opening an account. By creating one, you accept these terms, the Legal Notice, the Privacy Policy and the Data Processing Agreement.
1. The Service
TactiCourt is software for basketball coaching staffs: tactical whiteboard, plays, drills, practices, season, scouting, roster, stats, video, montage and travel plan. Some features depend on the plan you subscribe to.
2. Your account
- You must be of legal age and give us truthful information.
- You are responsible for keeping your password confidential and for everything done with your account. Only one active session is allowed per account.
- If you invite other people to your team, you decide which role and permissions they have.
3. Your data and your team's data
What you enter is yours. You are the data controller for the personal data of your players and coaching staff, and we are your processor (see the data processing agreement). You therefore agree to:
- Have a legal basis for entering that data and to inform the people concerned.
- Obtain explicit consent for health data (injuries, allergies, medication).
- Obtain authorization from the parents or legal guardians of players under 14 before processing their data. The app lets you record it on each player's card.
- Not upload unlawful content or content that infringes the rights of third parties.
4. Acceptable use
You may not attempt to access other teams' data, bypass plan limits, reverse engineer the software, or use it for unlawful purposes or in ways that harm other people or the Service.
5. Plans, prices and payment
- There is a free plan and paid plans (Coach, Team, Team Pro and Club, the latter custom-made). Details and current prices are on the plans page. Prices for consumers are shown including taxes.
- When you open an account you get a 15-day trial of the Team Pro plan (30 days for accounts created by December 31, 2026), no card required. When it ends, your account moves to the free plan with no charge and no loss of your data.
- Paid plans are purchased through Lemon Squeezy, which acts as the authorized seller (merchant of record) and handles payment and taxes. Before you pay you will see the final price, the billing period and the renewal terms.
- You can cancel at any time; cancelling prevents the next renewal and you keep the plan until the end of the period you paid for.
6. Right of withdrawal (consumers)
If you are a consumer and purchase a paid plan, you have the right to withdraw within 14 calendar days without giving a reason. Because the Service is digital and can begin immediately, when you purchase you may expressly request that it start right away and you acknowledge that, if you withdraw, you will pay the proportional part already provided, and that you will lose the right once the service has been fully provided. To withdraw, use the withdrawal function in the app (when available) or write to info@tacticourt.com. If you purchase as a professional or as a club (not a consumer), this right does not apply.
7. Availability, backups and your data
We make automatic backups and you can restore modules from the app, but we do not guarantee that the Service will always be available or error-free. We recommend keeping copies of anything important. When our relationship ends, we will keep your data for as long as needed for you to retrieve it and will then delete it, unless the law requires otherwise.
8. Artificial intelligence features
Some features (reading a stats sheet, drafting an analysis) use artificial intelligence from an external provider. What the AI generates is for guidance only and is labeled as such: review it before using it. These features are optional and only send the provider what you upload.
9. Intellectual property
The software, its design and its brand belong to the provider. We grant you a personal, non-exclusive, non-transferable license to use the Service while you have an account. Your content remains yours; you authorize us to process it solely to provide you with the Service.
10. Liability
We are liable for damages we cause through willful misconduct or gross negligence under the terms established by law, and we do not exclude what cannot be excluded. Except in those cases and except for what the law mandates in favor of consumers, our liability is limited to the amounts you have paid in the last 12 months. We are not responsible for any coaching decision you make with the help of the software.
11. Suspension and cancellation
We may suspend an account that breaches these terms or puts the Service at risk, notifying you where possible. You can close your account at any time by writing to info@tacticourt.com.
12. Changes
We may update these terms. If the change is significant, we will notify you and ask you to accept it again; if you disagree, you may close your account.
13. Governing law
These terms are governed by Spanish law. If you are a consumer, you may go to the courts of your place of residence; otherwise, to those of the provider's address, unless the law imposes another jurisdiction.
